"I am pleased to be able to sign these two bills today, to deal with what has become a growing problem for Alaskans as the internet becomes more prevalent in our homes," Murkowski said. "The potential for harassment by e-mail or telephone calls to escalate into a more serious problem is real, and HB 12 will make such harassment illegal. And for anyone who has a child who can go on-line knows, receiving sexually explicit e-mail into your mailbox is not something any child should be exposed to. HB 82 will help put a stop to that." HB 12 amends the crime of harassment by adding a prohibition of a person acting with intent to harass or annoy another person, from making obscene electronic communication, an electronic communication that threatens physical injury or sexual contact, or a telephone call that threatens sexual contact. HB 82 prohibits individuals from sending unsolicited commercial electronic mail that contains explicit sexual material, without the subject line of the communication containing the warning, "ADV:ADLT" as the first eight characters. The bill defines sexually explicit material. It also addresses electronic mail in the area of unlawful exploitation of a minor in Alaska law. It would also make it illegal to depict a child under 18 years of age engaged in certain sexual conduct in electronic mailings. Both laws take effect in 90 days.
